1. Who we are
Shardfall Pets is made by cyberIT gaming (“we”, “us”, “our”). You can reach us at support@cyberitgaming.com.
2. Who can play
If you are under 18, you need permission from a parent or legal guardian to use Shardfall Pets, and they agree to these terms on your behalf. Parents and guardians are responsible for any purchases made by their children.
3. Your account
- Keep your sign-in details safe. You're responsible for activity on your account.
- Give us accurate information and keep it up to date.
- Accounts are personal. Please don't sell, share or transfer yours.
4. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to download and play Shardfall Pets on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved by cyberIT gaming.
5. The floating pet
Shardfall Pets can display your pet over other apps once you grant Android's “Display over other apps” permission. You can revoke this permission at any time in your device settings. Please use common sense: don't interact with your pet while driving, crossing the road or doing anything that needs your full attention.
6. Virtual items and Shard Caches
- Items, outfits, food, currencies and other virtual goods (“virtual items”) are licensed to you, not sold. They have no real-world monetary value and can't be exchanged for cash or transferred outside the game.
- Shard Caches contain randomised rewards. If a Shard Cache can be obtained with real money, we will show the odds of receiving each type of reward in the app before you buy.
- In-app purchases are processed by Google Play and are subject to Google Play's terms and refund policies, as well as any rights you have under consumer protection law, including South Africa's Consumer Protection Act, 2008.
- We may change, rebalance or retire virtual items to keep the game fair and fun.
7. Playing nicely
You agree not to:
- cheat, use bots, exploit bugs or use unauthorised third-party software;
- hack, reverse engineer, decompile or interfere with the game or its servers, except where the law allows;
- harass, bully or threaten other players, or share hateful, sexual or illegal content;
- impersonate anyone, including cyberIT gaming staff; or
- use the game for any commercial purpose without our written permission.
When social features like Playdates launch, we may moderate names and content, and limit or remove access for anyone who breaks these rules.
8. Our content
Shardfall Pets, including its characters (like the Shard Dragon and Greenie), art, music, code and trademarks, belongs to cyberIT gaming or our licensors and is protected by intellectual property laws. If you send us ideas or feedback, you allow us to use them freely without owing you anything.
9. Updates and availability
We're always improving Shardfall Pets, so features may change, be added or be removed. Some features may need an internet connection. We aim to keep the game running smoothly, but we can't promise it will always be available or free of errors.
10. Ending this agreement
You can stop playing and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to stop offering the game. Where reasonable, we'll give you notice first.
11. Disclaimers
To the extent permitted by law, Shardfall Pets is provided “as is” and “as available”. Nothing in these terms limits any rights you have under applicable consumer protection laws that can't be excluded by contract.
12. Limitation of liability
To the extent permitted by law, cyberIT gaming is not liable for indirect or consequential losses, or for loss of virtual items, data or profits. Where liability can't be excluded, it is limited to the amount you paid us in the 12 months before the claim arose. Nothing here limits liability for gross negligence, fraud, or death or personal injury caused by our negligence.
13. Privacy
Our privacy policy explains how we handle personal information, in line with POPIA.
14. Governing law
These terms are governed by the laws of the Republic of South Africa. If you live elsewhere, you may also have the benefit of mandatory consumer protection laws where you live.
15. Changes to these terms
We may update these terms from time to time. We'll change the “last updated” date above and, for important changes, let you know in the app. If you keep playing after changes take effect, you accept the updated terms.
